Most likely it's legal because it's been in common use since before either of our countries had any type of anti-drug laws. After all, it was introduced to Europe when Sir Walter Raleigh brought it back to England from the New World in the late 1500's.
I believe if tobacco was a NEW substance it would be outlawed.
I don't think it would stand a chance of getting on the market today.
